These Terms and Conditions (“Terms”) govern your access to and use of the lightshowd website, applications, and software services (collectively, the “Service”) provided by Survesa, LLC (“Survesa,” “Company,” “we,” “our,” or “us”).
lightshowd is a software product and service operated by Survesa, LLC.
By accessing or using the Service, creating an account, or subscribing, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you have the legal capacity to enter into a binding contract.
2. The Service
lightshowd is a software platform provided by Survesa, LLC that enables users to design, plan, visualize, and manage holiday lighting layouts and related project information.
We may modify, update, or discontinue parts of the Service at any time, including adding or removing features.
3. Account Registration
To use certain features of the Service, you must create an account.
You agree to:
- Provide accurate information
- Keep your account information up to date
- Maintain the confidentiality of your login credentials
- Notify us immediately of any unauthorized use of your account
You are responsible for all activity occurring under your account.
4. Subscriptions and Billing
4.1 Subscription Plans
The Service is offered on a subscription basis, billed monthly or annually depending on the plan you choose.
4.2 Auto-Renewal
Unless canceled, subscriptions automatically renew at the end of each billing period. You authorize Survesa, LLC (or our payment processor) to charge your payment method at the then-current rate.
4.3 Cancellation
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of the current billing period unless otherwise required by law.
4.4 Fees and Taxes
All fees are listed in U.S. dollars unless stated otherwise and are exclusive of applicable taxes. You are responsible for any taxes, duties, or government fees associated with your subscription.
4.5 Refund Policy
Except where required by law, subscription fees are non-refundable. If you cancel, you will retain access until the end of your paid billing period.
4.6 Price Changes
Survesa, LLC may change subscription prices at any time. If pricing changes affect your plan, we will provide notice in advance as required by applicable law.
5. Free Trials and Promotions
Survesa, LLC may offer free trials or promotional access from time to time. Unless otherwise stated, trial subscriptions automatically convert into paid subscriptions at the end of the trial period unless canceled beforehand.
We reserve the right to modify or terminate trial offers at any time.
6. License and Permitted Use
6.1 License Grant
Subject to your compliance with these Terms, Survesa, LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.
6.2 Restrictions
You may not:
- Copy, modify, or create derivative works of the Service
- Reverse engineer, decompile, or attempt to extract source code
- Rent, lease, sell, sublicense, or transfer the Service
- Use the Service to build a competing product
- Circumvent any security features or access controls
- Use the Service in violation of laws or regulations
7. User Content and Data
7.1 User Content
You may upload or create content within the Service, including project designs, lighting layouts, photos, notes, measurements, customer information, or other materials (“User Content”).
You retain ownership of your User Content.
7.2 License to Company
By submitting User Content, you grant Survesa, LLC a worldwide, non-exclusive license to host, store, process, display, and use your User Content solely to operate, maintain, and improve the Service.
7.3 Responsibility for User Content
You are solely responsible for your User Content and represent that you have all necessary rights to upload and use it.
You may not upload content that is unlawful, infringing, defamatory, or harmful.
8. Intellectual Property
All rights, title, and interest in the Service, including software, designs, trademarks, logos, and documentation, are owned by Survesa, LLC or its licensors.
Except as expressly permitted, no rights are granted to you.
9. Acceptable Use Policy
You agree not to use the Service to:
- Violate any law or regulation
- Harass, abuse, or harm others
- Upload malware, viruses, or harmful code
- Interfere with or disrupt the Service
- Access another user’s account or data
- Use automated scraping or bots without permission
- Misrepresent affiliation with Survesa, LLC
Survesa, LLC may suspend or terminate accounts that violate this policy.
10. Third-Party Services
The Service may integrate with third-party tools (such as payment processors, cloud hosting, mapping services, or image rendering services). Survesa, LLC is not responsible for third-party services or their availability.
Your use of third-party services may be governed by separate terms.
11. Service Availability and Support
We strive to maintain uptime and availability but do not guarantee uninterrupted access.
We may perform maintenance that temporarily affects availability.
Support is provided on a best-effort basis unless otherwise specified in your subscription plan.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURVESA, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SURVESA, LLC DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DESIGNS OR OUTPUTS WILL BE ACCURATE FOR REAL-WORLD INSTALLATIONS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
IN NO EVENT SHALL SURVESA, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
SURVESA, LLC’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SURVESA, LLC IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so these limits may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless Survesa, LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any law or third-party rights
15. Termination
15.1 Termination by You
You may stop using the Service at any time and cancel your subscription.
15.2 Termination by Us
Survesa, LLC may suspend or terminate your access immediately if:
- You violate these Terms
- Your payment is overdue
- We believe your use poses a security risk or legal liability
15.3 Effect of Termination
Upon termination:
- Your license ends immediately
- You lose access to your account and stored content after a reasonable period
- Fees paid are non-refundable unless required by law
16. Data Retention and Export
We may retain User Content for a limited time after account cancellation to allow export or recovery. After that period, we may delete your data.
You are responsible for exporting your data before termination or cancellation.
17. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
18. Changes to Terms
Survesa, LLC may update these Terms from time to time. If changes are material, we will provide notice through the Service or by email.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
19. Governing Law and Venue
These Terms shall be governed by the laws of the State of North Carolina, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the state or federal courts located in Durham County, North Carolina, and you consent to jurisdiction and venue there.
20. Dispute Resolution (Optional)

Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally.
20.2 Arbitration Clause (Optional)
If you want mandatory arbitration instead of court, you should add an arbitration provision here.
21. Force Majeure
Survesa, LLC is not liable for delays or failure to perform due to causes beyond our reasonable control, including natural disasters, internet outages, strikes, or government actions.
22. Assignment
You may not assign these Terms without our prior written consent. Survesa, LLC may assign these Terms freely as part of a merger, acquisition, or asset sale.
23. Entire Agreement
These Terms, along with the Privacy Policy and any additional policies posted in the Service, constitute the entire agreement between you and Survesa, LLC regarding the Service.
24. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

Appendix A: Safety Disclaimer
lightshowd is intended for design and planning purposes only. Survesa, LLC is not responsible for electrical installation, code compliance, physical mounting, ladder use, weather conditions, or any injury, property damage, fire, electrical shock, or other loss resulting from installation or use of lighting products.
Users are responsible for ensuring all lighting installations comply with applicable safety standards, electrical codes, and manufacturer instructions.
Appendix B: Professional Use Disclaimer
If you use lightshowd for commercial or professional services, you are solely responsible for your client agreements, pricing, installation obligations, and project outcomes.
Appendix C: Output Accuracy Disclaimer
Measurements, visualizations, and layouts are estimates and may not reflect exact real-world conditions. You are responsible for verifying all measurements and design assumptions before installation or purchasing materials.
